REFUSE REMOVAL BYLAWS

Definitions

1. Household and Domestic Refuse" shall mean and include ashes, cinders, food refuse, tins, waste paper, floor sweepings and household garbage generally produced on any premises, whether occupied as a dwelling house or for trade or business purposes, but shall not include ashes from furnaces, trade and manufacturing refuse, sand or earth, liquid matter, garden refuse, lopping of trees, hedges or fences, building refuse, the manure or dung from animals or birds or stable sweepings.

"Refuse Receptacle" shall mean a receptacle for the reception of household and domestic refuse and shall be fitted with a close - fitting lid of a capacity of not more than 112 litres and shall be of a type approved by the Board.

"Load" shall mean a load contained in the smallest sized vehicle employed by the Board for the collection and removal of refuse.

"Refuse Removal Area" shall mean and include any area within the Township from which the removal of refuse from time to time be authorised by the Board.

"Nuisance" shall mean any condition whatever, which is unsightly, offensive, injurious or dangerous to health and anything whatever by which the health of the inhabitants is affected or may possibly be affected.

Refuse Receptacles

2. Every owner or his agent of residential premises and every occupier or his agent of business or trade premises within the township shall at all times which such premises are occupied, and maintain in a clean condition and in good order and repair on such premises are number of refuse receptacles stipulated by the Health Officer, or other duly authorised officer of the Board.

Every occupier of such premises or every person which has thus been provided with a receptacle shall cause such receptacle to be continuously covered with a close - fitting lid, save and when refuse is being deposited in or discharged from same and kept in a clean condition.

Deposit of Household and Domestic Refuse

3. Every occupier of premises or owner of unoccupied premises within the refuse removal area shall deposit or cause to be deposited in the refuse receptacle all household and domestic refuse produced or emanating from any source whatever on the premises occupied or owned by him.


Removal of Household and Domestic Refuse

4. The removal of household and domestic refuse from the receptacles provided in accordance with Bylaw No. 2 shall be undertaken by the Board on such day or days per week as the Board may decide; provided that such refuse receptacle shall be placed in a position approved by the Health Officer.

Household and Domestic Refuse Only to be Deposited in Receptacles

5. No person shall deposit or allow to be deposited in any refuse receptacle, the contents of which are removable by the Board, any refuse excepting household and domestic refuse.

Removal of Refuse Other than Household and Domestic Refuse Within the Removal; Area.

6. The occupier of any premises or owner of occupied premises within the refuse removal area on which there shall be produced refuse other than household and domestic refuse shall :

(a) provide suitable receptacle for the storage of such refuse pending removal and shall, when thereto required by the Health Officer or other duly authorised officer of the Board, provide the number of receptacles, of such type or construction as the Health Officer or other duly authorised officer of the Board may direct, for the reception and storage of such refuse pending removal; all such receptacles shall at all times be kept covered with a close-fitting lid, save when refuse is being deposited in or discharged form same, and kept in a clean condition; all such refuse produced or emanating from any source whatever on the premises shall be deposited in such receptacles;

(b) arrange for the removal and disposal of such refuse as often as may be necessary to prevent any undue accumulation of such refuse or any nuisance arising therefrom and also as often as he shall be required to remove and dispose of such refuse by a notice to that effect from the Health Officer or other duly authorised officer of the Board. The Board may undertake the removal of such refuse upon payment of charges a thereafter provided.

Disposal of Refuse from Premises Outside the Refuse Removal Area

7. The occupier of any premises outside the refuse removal area shall arrange for the removal and disposal by the Board or otherwise of all refuse produced on such premises as often as may be necessary to prevent any undue accumulation of such refuse or any nuisance arising therefrom an also as often as he shall be required to dispose of such refuse by a notice to that effect from the Medical of Health or anyother duly authorised officer of the Board.


Conveyance of Refuse

8. (a) Any person removing or conveying through or along any street or public place within the Township any refuse, dung or offensive matter or liquid or lime or building debris shall remove or convey the same in such a receptacle or other means of conveyance properly enclosed in such a manner as will prevent any nuisance arising therefrom or the escape of the contents of such receptacle or conveyance.

(b) If in the process of such removal or conveying any refuse, dung or offensive matter or liquid or lime or building debris be slopped or spilled or fall or escape from such receptacle or conveyance, the person so conveying or removing shall forthwith remove such matter from the place whereon same may have fallen and shall immediately thereafter thoroughly sweep or otherwise thoroughly cleanse such place.

(c) Such refuse shall be deposited at such place only as may from time to time be authorised by the Board and shall be properly covered or buried or incinerated in such manner as to prevent unsightliness or nuisance arising therefrom.

Unauthorised Deposit of Refuse

9. (a) No person shall throw, deposit of place or cause to be thrown deposited or placed or cause to flow in or on any street or public place both as defined in Section 2 (1) of Ordinance No. 21 of 1942, vacant lot, spruit or watercourse, any filth, slops, waste water, waste liquid, sweepings, rubbish, stable litter, garden refuse or any dirt, filthy or offensive matter of any kind whatsoever, whether liquid or solid, or any dead animal or broken cookery, glass or tin or discarded vehicles or machinery or any part thereof.

(b) No person other than passer-by shall throw, deposit or place or cause to be deposited or placed any filth papers, rubbish, garbage or any matter of any kind whatsoever in receptacles of containers placed by the Board on an y street, public place or thoroughfare. No person affected by the provisions of Bylaws No

(c) Any person who does or allows any such thing or things to be done mentioned in sub-bylaws (a) and (b) shall, when requested verbally or in writing to do so by the Health Officer or other duly authorised officer of the Board, remove such things within the specified time.

Unauthorised Interference with Refuse Receptacles

10. No unauthorised person shall interfere with, disturb or remove any refuse receptacle or container or the contents of any such receptacle or container for the time being upon any street or public place as in Bylaw No. 9 (a) declined within the Township.

Contravention of Bylaws

11. Any person ho contravenes any of the provisions of these Bylaws or who willfully obstructs, resists or hinders any officer or servant or other authorised by the Board in the lawful exercise or performance by him of his powers or duties or who willfully disobeys or disregards any lawful order served upon him in terms of these Bylaws shall be guilty of an offence and be liable, in the case of a first conviction to a fine not exceeding R50,00 in the case of a second or subsequent conviction for the same offense, a fine not exceeding R100,00 in default of payment of any fine imposed in either imprisonment for any period not exceeding three months; decoded that in the case of a continuing offence a fine not exceeding R5,00 for each day upon which the contravention continues may be imposed bur no such fine shall in any one prosecution or within any one month exceed R100,00.

12. Charges for the removal of refuse shall be levied in terms of Mtunzini Town Boards Tariff Bylaws and shall be payable in advance.

13. Regulation 1 of Chapter 1 (Sanitation) of the principal Regulations published under Provincial Notice No. 439 of 1974 on the 23rd October 1947, is hereby repealed.
