BYLAWS RELATING
TO DOG LICENCES IN THE AREA OF JURISDICTION OF THE MTUNZINI BOARD
1. For the purposes of
these Bylaws unless the context otherwise indicates "area"
means the area of jurisdiction of the Mtunzini Town Board;
"dog licence"
or "collector: means the Town Clerk or Treasurer of the Mtunzini
Town Board or any other officer or any person appointed by the Board
to issue dog licences;
"owner" in
relation to a dog shall have the same meaning as is signed thereto
by the Ordinance;
"prescribed fee"
means the licence fee payable in terms of the Ordinance;
"The Ordinance"
means the licensing and Control of Dogs Ordinance, 1942) as amended.
2. On and after the first
day of January in each year, the fees for dog licences in respect
of dog within the area of the Mtunzini Town Board shall be payable
to that Board for the benefit of its revenue fund and payment thereof
shall be made as in these Bylaws provided.
3. The prescribed fee
payable for a dog licence shall in the case of a dog which is of
age of six months or more on the first day of January in any year,
be paid to the dog tax collector not later than three last day of
February in that year, but otherwise within one month after the
happening of any event mentioned in sub section 3 of the Ordinance.
4. Application for a
dog licence shall be made to the collector in the form of schedule
No.1 to these Bylaws and shall be accompanied by the prescribed
fee.
5. Upon payment of the
prescribed fee and the completion of the prescribed form of application,
the collector shall issue to the applicant :
(a) a dog licence printed
in the form of Schedule No. 2 these Bylaws, which shall in addition
to the date of issue and a serial number, set forth the name and
address of the owner of the dog and the sex colour and breed or
apparent breed of such dog, and any other matters which may be deemed
necessary r desirable; and
(b) a badge of durable
material suitable designed for secure attachment to a dog collar,
having impressed thereon the letter "MTB" for Mtunzini
Town Board, the year of issue and a serial number corresponding
with such year and serial number shown upon licence.
6. Whenever forms of
licences are contained in books with counterfoils, the counterfoil
shall in every case be so completed as to reflect the information
contained in the corresponding licence. In all other cases a duplicate
(or carbon) copy of every licenses shall be made and retained for
filing.
7. If the badge issued
in terms of Bylaw 5 (b) is lost or destroyed, the owner of the dog
concerned may obtain a duplicate thereof from the collector upon
satisfying him of such loss destruction and upon payment of a fee
of ten cents.
8. Any person who, in
making written application for a dog licence, makes any statement
which he knows to be false, or which he does not know to be true,
shall be guilty of an offence.
9. Any policeman or dog
tax collector may at any time reasonable for the performance of
the duty enter any premises for the purpose of enquiring or ascertaining
whether any dogs or how many dogs are upon such premises, or for
the purpose of inspecting dogs and dog licences and badges.
10. A policeman or dog
tax collector may in the exercise of the authority conferred upon
him by Bylaw 9, require any person who may reasonably be supposed
to be able to give the sane, to furnish him with information upon
any matter or matters mentioned in the said Bylaw, and if such person
fails or refuses to give the information required of him to the
best of his knowledge and belief, or gives false or misleading information,
he shall be guilty of an offence.
Penalty
11. Any person who contravenes
any of these Bylaws shall be guilty of an offence and liable, on
conviction, to a fine not exceeding Fifty rand (R50) in the case
of a first conviction or, in the case of a second or subsequent
conviction for the same offence, a fine no exceeding One Hundred
Rand (R100) or in default of payment of any fine imposed in either
case to imprisonment for any period not exceeding three months;
provided that in the case of continuing offence, a fine not exceeding
Five Rand (R5) for each day upon which the contravention continued
may be imposed, but no such fine shall in any one prosecution or
within any one month exceed one hundred rand (R100).
12. The Bylaws relating
to Dog Licences made under Provincial Notice No. 541 of 1946, are
hereby repealed.
